Container Moving Solutions LLC (“CMS”) shall repair and/or replace defects in material or workmanship in its new products for twelve (12) months from the date of delivery stated on the warranty certificate from CMS.
CMS will cover the following components:
Bed
Subframe
Inner and Outer Boom
Crossbar
Hydraulic Cylinders
CMS Electronics
Hydraulic Valves
Aluminum Ramps
CMS Container Trailer
CMS agrees only to repair or replace, at its option, any covered part which is found to be defective in material or workmanship during the applicable warranty term. Warranty service will be performed at the CMS Service Center or a service center authorized by CMS. Any warranty issues must be approved by CMS prior to repairs performed to qualify. CMS reserves the right to use new or remanufactured parts or components. The purchaser will be responsible for any transportation to and from the authorized repair service center.
To secure warranty service, the purchaser must (1) Report the product defect to CMS and request repair within the applicable warranty term, (2) Make the equipment available to CMS or authorized repair center within a reasonable period of time.
Defects caused by operation beyond rated capacity or improper use or application will void the expressed warranty and the customer will be responsible for any repair costs. Routine maintenance, routine maintenance items prone to wear and tear (including, but not limited to pins, bushings, hoses, wiring harnesses, synthetic rope, light bulbs, wear pads, batteries, tires, paint, bed lining) are excluded from this warranty.
Under no circumstances shall CMS be liable for any consequential or special damages which any person or entity may incur or claim to incur as a result of any defect in the product or in any correction or alteration thereof made or furnished by CMS. “Consequential” or “special damage” includes, but is not limited to costs of transportation, lost sales, lost orders, lost profits, lost income, increased overhead, labor, material costs and cost of manufacturing variances and operational inefficiencies. CMS maximum liability under this warranty shall be the purchase price paid to CMS with respect to the product which such warranty is claimed.
CMS reserves the right to revise this document at any time.
